Pursuant to subsection 36(2) of the Human Rights Code, the Commission has decided not to refer the subject matter of this complaint to the Board of Inquiry for the following reasons:
1. The evidence is insufficient to indicate that the complainant was subjected to unequal treatment or harassment in services because of race, ancestry, colour or ethnic origin.2. The evidence indicates that the complainant's application was declined because the respondent's admissions committee concluded that other applicants were more likely to succeed in the faculty's program.
3. The evidence also indicates that the respondent did not admit the complainant to its law school becuase, in addition to other factors, the complainant had a Grade Point Average that was lower than the average required for admission to its law faculty and lower than that of the successful candidates.
For the above reasons, the Commission is of the view that the evidence in this matter does not warrant referral of the subject matter of the complaint to the Board of Inquiry.
